Air2Ground Services (PTY) Ltd. ("the Company") is a certified Civil Aviation operator - CAA license SACAA.UASOC.2121.G1702D - and operates under the regulatory authority of the Civil Aviation Authority. Flights undertaken for the purposes of completing a commercial service are regulated and controlled by the Civil Aviation Regulations 2011, and Part 101 of the Civil Aviation Regulations. The Company is committed to ensuring complete compliance with all Civil Aviation Regulations. Failure to comply with these regulations constitutes a civil and legal breach of Regulatory controls.
TERMS AND CONDITIONS
Landowner Permission
1. The Company undertakes to ensure that they have the required authority to undertake flights on the Client behalf at locations across South Africa where such services are contracted by the Client.
2. Client(s) are requested to grant or gain permission for contracted flight services at the contracted location by providing Landowner Permission for the flight over their property.
3. Acknowledgement of these Terms and Conditions constitutes acknowlegement that you have authority to grant permission for the flight of our aircraft over the property on which service has been contracted
4. The Client may revoke this permission at any time by informing the Company in writing of such a revocation.
5. The Company acknowledges that the acknowledgement of these Terms and Conditions constitutes a binding agreement for the purposes of the specific flight only, and does not constitute an ongoing and permanent permission for overflight at any point in the future.
6. The flight permission granted herein is not extendable, transferrable or revokable by any other party not herein contemplated as part of the service agreement between the Client and the Company unless otherwise authorised in writing by said parties.
Flight Safety
1. Air2Ground prioritises the safety of you, your assets, and the public and undertakes to ensure that each flight is undertaken with the strictest adherence to safety and security.
2. Air2Ground (PTY) Ltd. reserves the right to cancel or re-schedule any flight based on safety or security concerns where it reasonably feels that the flight cannot continue. This may include but is not limited to; weather conditions, site safety, permission concerns, failure to effect payment as per the terms and conditions stipulated, airspace conditions, regulatory changes, human factors or site access restrictions.
Service Quality Commitment
1. The Client, as contracted, commits to ensuring that accurate information is provided with regards to the particulars of the property, the requirements of the works to be undertaken and the expectations therein.
2. Air2Ground (PTY) Ltd. , when duly contracted, commits to ensuring that works undertaken are completed to the required standards as contemplated in the contractual agreement between the Client and the Company.
3. The Company commits to undertake fair arbitration in any dispute arising out of complaints relating to service delivery as they arise and agrees to submit to reasonable external arbitration to resolve service delivery concerns and complaints.
Privacy
1. The Company, as contracted, commits to ensuring that the Client's privacy is maintained and preserved at all times while undertaking the contracted services.
2. The Client reserves the right to not have their property, activities or person filmed, photographed or otherwise recorded in any way while undertaking services with the Company.
3. Aircraft camera recordings, where required for flight safety and service delivery, are strictly controlled under the POPI Act and copying, modification, distribution or sale are strictly forbidden.
POPIA DISCLAIMER
Air2Ground Services (Pty) Ltd, our subsidiaries and affiliates are required to process personal information in accordance with the Protection of Personal Information Act, 04 of 2013 (“POPIA”). Air2Ground Services (Pty) Ltd,
By entering into contractual agreement with Air2Ground Services (Pty) Ltd, you give permission to Air2Ground Services (Pty) Ltd, our subsidiaries and affiliates to collect and process personal information, as contemplated in the POPIA Act, for the purpose for which you shared such information with us.
The Company commits that the personal information gathered, either advertently or inadvertently during the course of this agreement is to be treated as confidential and only processed lawfully for the purpose for which it was disclosed. The Company understands that the Unlawful processing of personal information may give rise to a formal complaint or legal action.
Client(s) may undertake to request that their personal information be redacted, modified, amended or deleted at any time within the bounds of the legislation and prevailing regulations.
